Privacy Policy

In order to facilitate our provision of services, DL Services Inc. dba Mr. and Mrs. Italy (“Mr. & Mrs. Italy,” “we,” “us,” or “our”) requests and utilizes certain personal information detailed below from our clients (“Personal Information”).  This Privacy Policy details how we obtain, use, and share your Personal Information in providing our services.  By using our services or sharing your personal information with us, you are accepting and consenting to the practices described in this Privacy Policy. 


Please read this Privacy Policy carefully. We recommend that you print a copy of this Privacy Policy and any future versions in force from time to time for your records.


1.    Disclosed Personal Information
   In connection with providing services, we may request that customers provide the following Personal Information:


    a.     Personal Identification Information (“PII”) – This information may include, but is not limited to, your name, email address, mailing address, phone and/or cell number, passport data, and other contact and identification information. 
    b.     Personal Health Information (“PHI”) – This information may include, but is not limited to, dietary restrictions, food allergies, any other food and beverage limitations or preferences, age, gender, height, weight and general physical capabilities and mobility.
    c.     Payment Information (“Payment Information”) – This information may include credit card payment information or similar information needed to process payments made in connection with our services.


2.    Our Use of the Personal Information.
  We may use the Personal Information provided to us to facilitate our provision of services including but not limited to the following:
    a.    To process payments and other financial transactions due for our services or the services of third party vendors and service providers;
    b.    To register you for an account, keep in contact with you, and provide you with information regarding our services;
    c.    To provide our services to you in connection with planning your transportation, accommodations, experiences, and any other arrangements needed for your trip; 
    d.     To enforce our Terms and Conditions or to otherwise protect our rights;
    e.    To facilitate our communications with you including sending you information,  confirmations and receipts, technical notices, updates, security alerts, surveys and support and administrative messages;
    f.    To respond to your inquiries and provide customer service related to your use of our products and services;
    g.    To address any problems, resolve disputes, and enforce applicable agreements and policies; and
    h.    To fulfill any other purpose consistent with this Privacy Policy or for purposes disclosed to you at the time we collect your Personal Information.  


3.    Disclosure of Personal Information to Third Parties
   In connection with providing our services, including the planning of appropriate accommodations and experiences for your trip, we may share your Personal Information with third parties such as third party vendors and service providers, subject to the following terms.
    a.    We do not share, sell, trade, or rent any of your Personal Information to third parties for their own promotional or marketing purposes.  
    b.    We do not share Payment Information with any third parties, and any Payment Information provided to us is used only for processing payments or transfers of funds directly to Mr. & Mrs. Italy.
    c.    PII and PHI may be shared with third party vendors and service providers to the extent necessary to provide such services and to ensure that such services and experiences are compatible with any applicable dietary or medical restrictions.
    d.    We may share your Personal Information with any third parties that you have specifically consented to use your Personal Information or to whom you have specifically directed us to disclose such Personal Information. 
    e.     We may disclose your Personal Information to the extent we are legally required to do so in order to comply with applicable law, governmental requests, a judicial proceeding, court order, or legal process, such as in response to a court order or a subpoena (including in response to public authorities to meet national security or law enforcement requirements).
    f.    We may share Personal Information to the extent you have made such information public.
    g.    We may disclose your Personal Information where we believe it is necessary to investigate, prevent, or take action regarding potential violation of our policies, suspected fraud, situations involving potential threats to the safety of any person and illegal activities, as evidence in litigation in which we are involved, or to otherwise protect the rights or safety of any person or entity.


4.    Your Access to and Control Over Information under General Data Protection Regulations of the European Union and the United Kingdom (GDPR)
If the processing of your Personal Information is subject to the data protection laws of the European Union or the United Kingdom, you have certain rights with respect to that data. For the purposes of the GDPR, Mr. & Mrs. Italy is the data controller.
 

We describe in the sections above titled “Our Use of the Personal Information” and the “Disclosure of the Personal Information to Third Parties” the purposes for which we use the Personal Information provided to us and share.  Where we are using the Personal Information in order to provide services or products to you, our legal basis for such use is on the basis of our contract with you.  For all other purposes our legal basis is our legitimate interest in running our business, except where we obtain your consent for a particular processing, in which event the legal basis will be your consent.
 

Your rights.  To exercise any of your rights identified below, please contact us at info@mrandmrsitaly.com. Please note that these rights are limited, for example, where fulfilling your request would adversely affect other individuals or where we are required by law to retain your personal data.
 

Access and portability. You are entitled to request access to your Personal Information we hold and be provided with certain information about how we use your personal data and who we share it with. Where you have provided your personal data to us with your consent, you have the right to ask us for a copy of this data in a structured, machine readable format and to ask us to share (port) this data to another data controller.
 

Correction.  You have the right to ask us to correct your Personal Information where it is inaccurate or incomplete.
Right to deletion.  In certain circumstances, you have the right to ask us to delete the Personal Information we hold about you.

 

Restriction.  In certain circumstances, you have the right to ask us to restrict (stop any active) processing of your Personal Information.
 

Objection.  You can object to our processing of your Personal Information based on our legitimate interests and we will no longer process your Personal Information unless we can demonstrate an overriding legitimate ground.
 

Withdrawal of consent.  In the event we have relied upon your consent to process your Personal Information, you may withdraw consent at any time by contacting us at info@mrandmrsitaly.com.
 

Complaints.  In the event that you wish to make a complaint about how we process or use your Personal Information, please contact us in the first instance at info@mrandmrsitaly.com and we will endeavor to deal with your request as soon as possible. This is without prejudice to your right to raise a complaint with a relevant supervisory authority.

5.    Your Access to and Control Over Information under applicable laws of the United States
The following information applies to all users of Mr. and Mrs. Italy Services regardless of your State of residence.  

 

If you are a California resident, the following information provides you with the information you need to exercise your rights under the California Consumer Privacy Act (CCPA).  If you are resident of Colorado, Connecticut, Utah, Virginia, Iowa, Indiana, Tennessee, Oregon, Montana, Texas, Delaware, Florida, New Jersey, or New Hampshire, this information will provide you with the information you need to exercise your rights under your State’s Privacy Laws as they come into effect.
 

Mr. and Mrs. Italy understands your concern about control over your information. Therefore, you can do the following at any time by contacting us via mail, email, or phone using the contact information given below:
 

    (a) See what data we have about you, if any.
    (b) Change, correct, or update any data we have about you.
    (c) Express any concern you have about our use of your data.


In addition, if you already have a Mr. and Mrs. Italy user account, you can log in to your user account in order to see or update your information.


We collect information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or device (“personal information”). If you are a California resident, be aware that Personal Information does not include:

  • Publicly available information from government records.

  • De-identified or aggregated consumer information.

  • Information excluded from the CCPA’s scope, like:

    • health or medical information covered by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the California Confidentiality of Medical Information Act (CMIA) or clinical trial data;

    • personal information covered by certain sector-specific privacy laws, including the FCRA, the GLBA or California Financial Information Privacy Act (FIPA), and the Driver’s Privacy Protection Act of 1994.
       

Sharing your Personal Information
In the preceding 12 months, we have disclosed the following categories of information for the business purposes described in Section 2, above:

  • Personal information categories listed in the California Customer Records statute (Cal. Civ. Code § 1798.80(e))

  • Protected classification characteristics under California, other States, or federal law.

  • Commercial Information

  • Internet or other similar activity

  • Inferences drawn from other personal information

We disclose these categories of personal information for business purposes to the following categories of third parties:

  • Our partners

  • Our service providers and other third parties that cannot use personal information collected by or on behalf of us for their purposes, including but not limited to advertising networks, business process outsourcing providers, internet service providers, data analytics providers, data processors and storage providers, operating systems and platforms, social networks, and consumer data resellers.

  • Third parties to whom you or your agents authorize us to disclose your personal information in connection with the products or Services we provide to you.

 

Selling your Personal Information
In the preceding 12 months, we have not sold any categories of personal information.

 

Rights of California Residents
The following terms are written to comply with the CCPA, but you may avail yourself the benefit of these terms no matter your State of residence:

 

Pursuant to the CCPA, California residents have the right to submit the following requests to Mr. and Mrs. Italy. Mr. and Mrs. Italy is prohibited from discriminating against you in any way in response to your exercise of any of these rights. This means we will not:

  • Deny you goods or services.

  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.

  • Provide you a different level or quality of goods or services.

  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

  • Offer a product enhancement or financial incentive that is contingent on you sharing personal information, unless that incentive is reasonably related to the value provided to us by that collection.

To ensure personal information security and prevent fraudulent requests, we may need to collect personal information and other information such as your name, email, or transaction history to verify your identity. Any authorized agents making requests on your behalf need to provide similar information for verification.
 

Access
You have a right to request Mr. and Mrs. Italy provide you with the following information, covering the 12 months preceding the date your request is submitted:

  • The categories and specific pieces of personal information collected about you

  • The categories of sources of the personal information collected about you

  • The business or commercial purposes for collecting or selling your personal information

  • The categories of third parties to whom we sold your personal information

  • The categories of third parties to whom we disclosed your personal information for a business purpose

 

Deletion
You have the right to request Mr. and Mrs. Italy to delete the personal information collected from you, subject to certain exceptions. Once we receive and confirm your verifiable request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.

 

We may deny your deletion request if retaining the information is necessary for us or our service providers to:

  • Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.

  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.

  • Debug products to identify and repair errors that impair existing intended functionality.

  • Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.

  • Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 seq.).

  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent.

  • Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.

  • Comply with a legal obligation.

  • Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

 

Opt-Out

6.     Security
We take precautions to protect your information. When you submit sensitive information via the website, your information is protected both online and offline.


Wherever we collect sensitive information (such as credit card data), that information is encrypted and transmitted to us in a secure way. You can verify this by looking for a closed lock icon at the bottom of your web browser, or looking for “https” at the beginning of the address of the web page.


While we use encryption to protect sensitive information transmitted online, we also protect your information offline. Only employees who need the information to perform a specific job (for example, billing or customer service) are granted access to personally identifiable information. The computers/servers in which we store personally identifiable information are kept in a secure environment.

 

7.    Changes to Our Privacy Policy
We reserve the right to amend, modify or revise this Privacy Policy from time to time in our sole discretion.  The most current version of this Privacy Policy will govern our use of your Personal Information and will be available at www.mrandmrsitaly.com/privacy-policy. If we make a change to this Privacy Policy, by continuing to utilize our services or by accessing and using this website after those changes become effective, you agree to be bound by the revised Privacy Policy.   We encourage you to review this Privacy Policy frequently to be informed of how we are protecting your Personal Information.
